Mandatory for

Law 2/2023 specifies that the following entities must have an internal information channel and an information management procedure:

Public administrations

The set of bodies set up to carry out the task of administering and managing institutional bodies and state entities.

Companies with more than 50 employees

All companies with more than 50 employees regardless of their activity

SMEs and micro-SMEs

All those falling within the scope of the European Union in the areas of financial services, products and markets, prevention of money laundering or terrorist financing, transport security and environmental protection.

Public Funds

Business organizations whenever they receive or manage public funds, therefore all bidding companies and all those who want to access European Next Generation funds.

Law 2/2023 of 20 February on the protection of persons who report regulatory infringements and on the fight against corruption transposes European Directive 2019/1937, known as the Whistleblowers Directive. The purpose of the regulation is to protect persons who, in a work or professional context, detect serious or very serious criminal or administrative offences, or an infringement of European Union law, and report them through the mechanisms regulated by Law 2/2023.

Complaints management

1st stage: the Viadenuncia channel receives the communications and makes an initial discrimination.
2nd stage: the recipient sends the communication to the system manager, securely, by sending an encrypted PDF to a secure email, which can be opened with the password sent to your phone.
3rd Stage: Viadenuncia communication management procedure, the system manager may use the Viadenuncia procedure, and its legal and/or IT technicians if necessary.

Training

On 13 March, Law 2/2023 on the protection of persons who report regulatory infringements and the fight against corruption, which transposes the European Directive 2019/1937 known as the Whistleblowers Directive, came into force.

The deadline for setting up internal reporting systems and adapting existing ones is 13 June 2023.
