d&#8217;individus que denuncien incompliments legals i lluiten contra la corrupci\u00f3, ha introdu\u00eft l&#8217;obligaci\u00f3 d&#8217;implementar un proc\u00e9s de gesti\u00f3 de dades mitjan\u00e7ant l&#8217;\u00f2rgan d&#8217;administraci\u00f3 o govern de totes les entitats obligades a disposar d&#8217;un Sistema intern d&#8217;informaci\u00f3.<span style=\"font-size: inherit;\"><\/span>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-519bddee elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"519bddee\" data-element_type=\"section\" align=\"justify\">La nova <b>Llei 2\/2023<\/b> reguladora de la protecci\u00f3 de les persones que informen sobre infraccions normatives i de lluita contra la corrupci\u00f3 ha establert la <strong>necessitat d&#8217;aprovar un procediment de gesti\u00f3 d&#8217;informacions<\/strong> a trav\u00e9s de l&#8217;\u00f2rgan d&#8217;administraci\u00f3 o de govern de cada entitat obligada a disposar d&#8217;un Sistema intern d&#8217;informaci\u00f3.<\/p><p lang=\"ca-ES\" align=\"justify\">El deu punts b\u00e0sics que constitueixen el contingut m\u00ednim i els principis essencials que hauran de regir el procediment de gesti\u00f3 d&#8217;informacions s\u00f3n els seg\u00fcents:<\/p><ol><li><p lang=\"ca-ES\" align=\"justify\"><strong>Identificar els canals interns d&#8217;informaci\u00f3 associats al Sistema intern d&#8217;informaci\u00f3<\/strong>. Per tant, caldr\u00e0 identificar si el sistema t\u00e9 per objecte la recepci\u00f3 de comunicacions relacionades amb prevenci\u00f3 de blanqueig de capitals, mat\u00e8ries de la Directiva UE 2019\/1937, fons Next Generation, assetjament, contractaci\u00f3 p\u00fablica i\/o Compliance.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\"><strong>Informar sobre els canals externs d&#8217;informaci\u00f3<\/strong> de les autoritats competents auton\u00f2miques, estatals o europees (Oficines Antifrau, OLAF, etc.).<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Preveure la tramesa d&#8217;un <strong>acusament de rebuda a l&#8217;informant<\/strong> en un termini de set dies naturals seg\u00fcents a la recepci\u00f3 de la comunicaci\u00f3. S&#8217;exceptuen els sup\u00f2sits que puguin posar en perill la confidencialitat de la comunicaci\u00f3.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Establiment d&#8217;un termini m\u00e0xim de <strong>tres mesos <\/strong>per a donar resposta a les actuacions d&#8217;investigaci\u00f3. En assumptes <strong>d&#8217;especial complexitat<\/strong>, el termini pot ampliar-se a un m\u00e0xim de tres mesos addicionals.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Preveure la <strong>possibilitat de mantenir comunicaci\u00f3 amb l&#8217;informant<\/strong>, especialment en aquells sup\u00f2sits que sigui necessari sol\u00b7licitar-li informaci\u00f3 addicional.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\"><strong>Previsi\u00f3 dels drets de la persona afectada<\/strong> a ser informada de les accions i omissions que se li atribueixen i a ser escoltada en tot moment. Aquesta comunicaci\u00f3 tindr\u00e0 lloc en el temps i forma adequats, evitant frustrar el bon fi de la investigaci\u00f3.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Establiment de la <strong>garantia de confidencialitat<\/strong> quan la comunicaci\u00f3 sigui enviada a trav\u00e9s de sistemes que no siguin els establerts. Caldr\u00e0, en aquest sentit, advertir al personal no responsable del seu tractament de la responsabilitat que comporta el fet de no trametre immediatament la comunicaci\u00f3 rebuda al responsable del sistema.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Previsi\u00f3 del respecte a la <strong>presumpci\u00f3 d&#8217;innoc\u00e8ncia i a l&#8217;honor<\/strong> de les persones afectades.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Previsi\u00f3 del respecte a les disposicions sobre la <strong>protecci\u00f3 de dades personals<\/strong>.<\/p><\/li><li><p lang=\"ca-ES\" align=\"justify\">Previsi\u00f3 de<strong> remissi\u00f3 immediata al Ministeri Fiscal <\/strong>dels fets sobre els quals hi hagi indicis de delicte.
